Withdrawing a Listing |

I put my house up for sale and I signed a listing agreement with a realtor for 120 days. My realtor failed to properly market my home in several respects; no showings, no open houses, improperly listed on the MLS, no newspaper ads, no broker open houses, etc...After 90 days I called my realtor and let him/her know I no longer required his/her services and wished to remove my home from the market. My questions is this: The listing agreement expires shortly and I'd like to either rent out my house, find a rent to own type of buyer, or perhaps even eventually find a buyer on my own. Since my realtor didn't show my house to one person, am I responsible for paying the realtor a commission if I rent out my home after the listing expires? What if I am able to sell it on my own after the listing agreement expires? |

It isn't clear whether you have actually withdrawn your listing, which should be done in writing on a form that will be acknowleged and noted by the multiple listing system. Be sure you are dealing with the managing broker in the office, because your listing contract is probably with the company, not the individual agent you are working with. I haven't seen your listing contract, but I'll bet the answer to your questions is in there. In many listing forms, the seller promises a commission if the property is sold, within a certain length of time after the listing expires, to someone who first saw it while it was listed. |
