What Does "Re-Listing" Mean? |

My listing just expired, and I suspect that one party that was interested will approach me. There is a 60 day clause that says I have to pay the commission to the old broker if I sell to someone who has seen the house; I understand that. It also says "unless the property is re-listed". Can I sign up for an FSBO MLS listing, or throw an agent $1000 to give me an open listing to avoid the 60 day wait? There is no wording on the contract that says what type of listing voids the clause. |

That's an intriguing question. The broker-protection clause, and its exception, was probably written before the days of discount brokerages and Internet listings. I just can't guess what a judge would say if the question came to a court fight. |
