Owners Can't Agree |
| |
 |
I own a home in NYC with the father of my children. My name is on the deed as well as the mortgage. We can not come to an agreement own how much he should buy me out for. I would like to have the house forcibly sold through the courts. What is the process that I should go through? And, what do you advise? |

A court-ordered "partition" of the property means a public auction sale, which seldom yields full value, and involves legal expenses. I certainly wouldn't advise it. One solution in a situation like yours is for each party to hire a qualified appraiser, with an advance agreement that the buy-out price will be an average of the two estimates. Hope this helps! |
