Edith: As I understand it, when an agent moves from one broker's office to another, he/she may not take listings with them from the previous broker's office. Does this include any and all listings? Even the listings that were originated with that agent?
The salesperson or broker signs a listing contract on behalf of the brokerage company. It’s the firm that is hired to market the property, not the individual agent. If the agent leaves, the listing contract is still in effect with that company.
Each firm may have its own policies about what happens at that point, perhaps spelled out in the independent contractor agreement signed when the agent joined the firm. Otherwise it’s up to the brokerage company to decide whether special circumstances might justify transferring any listing.
