Earnest Money Check

  Our buyer's disclosed on their finance statement they have $10,000 in a checking account. They wrote an earnest money check for $20,000 on this account. All other items on the contract are acceptable. Do we have a contract if we don't know the check has cleared?
 
  I'm not a lawyer and I haven't seen your contract, but my guess is that it still might be valid even if the check doesn't clear.  You have the right to know promptly if it doesn't.
