Conflict of Interest |

Hi:
I want to sell my house as quickly as possible. My husband and I are now legally separated and I want to move out of the house very soon. The question is: If I use one particular real estate broker to sell the house, would it be a conflict of interest to use the same broker to find me a decent place to live? My husband is not in any rush to leave the premises. He feels that if I use the same broker, the broker will try to sell the house too quickly without getting the full market value. I am willing to wait a reasonable amount of time to sell the house. I know the market has slowed down recently, but six months seems like a fair amount of time. I will need the proceeds of the house (which will be divided in half) within that period of time. Do you think there is a conflict of interest? Thank you for reading this. I am awaiting your answer. As an extra piece of information, my husband is an attorney and he thinks it is a conflict of interest. What is the correct answer, since I do not know the law.

I don't htink there's a conflict of interest, but to be practical, perhaps you can speed the process up by using your own broker to buy and letting your husband pick the one to do the selling. That avoids the argument. Otherwise, you may hit a snag when your husband objects to the offer your broker produces and refuses to accept it. It might be better to let him feel okay about the broker and it might get the house sold faster. |
