Zoning Was Wrong

  Hi Edith,
I bought my house in 2005 as my primary residence. It was zoned as a primary residence and have been paying taxes as a primary residence. I went to sell my house in November 2007 and the buyer's title search came up with a violation. My house was now zoned as a seasonal dwelling. The tax assessor's office made a mistake in zoning as a primary residence years ago but only caught this mistake now. I have had to spend thousands to change the zoning to meet their requirements as well as lost the sale of my house. Do I have a right to reimbursement in fees and loss of sale?

  I can't tell whether someone could be held liable for not discovering the zoning situation when you were buying.  You'll have to consult a lawyer, preferably one who specializes in real estate.  If the property is located in a small town area, you may want to talk with a lawyer some distance away, to get the most perspective on who might be held responsible.
