This is complicated. First off we listed our home, with the advisement of the realtors, taking 20% off the price that it appraised due to the fact that there were a few things left to be finished and the agreement was that the "few "were not going to be finished. Well we have gotten weaseled into finishing those "few things" in the sale of our home, but still lack the 20% ($52,000). Now two days before closing the title company says there is an unclear title and we have to hire an attorney before we can proceed, to clear up the title. Well, we already spent all saved money finishing things that should have never been done. In fact we would rather just drop the sale and keep the house now due to the fact that we are getting screwed and we don't want to proceed. Can we refuse to hire an attorney? |

You don't have to hire an attorney, but your buyer isn't going to go through with the purchase if there's some question about whether you can turn over unchallenged ownership. I doubt if anyone will buy as long as there's what is known as a cloud on the title. |
