Too Many Heirs |

5 family members are owners to my mother's property. 2 family members which are my nephew seem to think they have more rights to the house, then we do. They made taxes fall behind by $3,500. We get citations very time taxes fall behind, and they don't. There is alot of hanky panky in the house that we know off. 4 of us have agreed to sell the house and have closure regarding my mothers memory. The problem is my nephews have the key to the house, and we are not able to get in without confrontation from them. Please advice. |

You need to talk with a lawyer promptly. It can be very dangerous to let the taxes go unpaid -- you could all lose the property. Discuss with the attorney whether you can change the locks, and what your rights are about forcing a public sale of the property "partition". Ask your lawyer if, when the place is sold, you could be reimbursed for any extra share of the taxes you paid. Partition sale is not a good solution -- it usually results in a poor sale price. But just threatening to do it may make your nephews more cooperative. Then you can put the place on the market together. |
