Taking Down Tree |

There is a very large tree at the corner of my lot. A surveyor put a nail in the tree right on the lot line. There is one large root and about 4/5 inches of tree on her land and the rest (about 3 feet round) on my land. The tree is clearly inside the fence on my land and it overhangs my house. It has carpenter ants which fall from the tree onto my roof /house and are now all over my yard and porch. The tree is not in good health. I told my neighbor I was pricing the removal of the tree. Clearly she does not want me to take it down and told me I had to check with her before I did anything. Is this so? If 90/95% of the tree is within my property and close to my house, why do I need to ask per permission. If it falls it will hit my house. Her house is not near the tree. |

Sounds to me as if you can do what you like with this tree, but I haven't seen it of course. Better check with a quick phone call to your own lawyer. |
