If I have power of attorney for someone who is in a nursing/veterans home and must sell that person's home to provide for their future welfare, am I legally required to accept only the highest offer for the property? Or may I choose who I want to sell the home to, regardless of whether the offer is the highest? |

You'd better consult an attorney to see just what your fiduciary duties are. A lot may depend on who else has an interest in that person's estate, whether the government or heirs, and whether ano\yone could accuse you of self-serving. There are times when one can defend a lower offer as being the best, for other reasons. But I'm not a lawyer, and your best bet is to do nothing without consulting an attorney --preferably the one for that person in the nursing home. |
