One Doesn't Want To Sell |

Dear Ms. Lank,
I am writing you for my Dad. His question is, How do you force a property sale, when one wants to sell and one does not want to?
I appreciate if you could help my Dad out with any information on this situation.

Either owner can go to court and ask for a forced sale of the property and division of the proceeds. The only time this might not be possible is if they were husband and wife, where different state laws could apply. A forced sale at public auction seldom yields full value of the property, and of course it involves legal costs. It should be a last resort, when all other attempts to agree have failed . |
