No Wwiii

Dear Mrs. Lank: Recently we bought a house especially so our children could play outdoors. There is a house behind us that is landlocked and the only way is through our property. They have an easement to allow them access over our driveway.

Lately they’ve been parking right under our window, and their guests use the driveway so fast that I’m afraid to let my children play outside without supervision. Sometimes there’s real noise from several cars parked on the driveway. When I asked that a car be moved I was told “It’s our driveway and we can park anywhere we want.”

My husband doesn’t want to start WWIII about this. I am sure if we went to court we’d win because we are not barring them from access. But this is a small town and we’d like to have legal action as a last resort

You do need to talk with a lawyer, though. It’s possible your neighbors really do think they own the driveway.Probably all they own is the right to go over it to get to their property. If that’s the case, a polite letter from your attorney, explaining the limit of their rights, might do the trick.
