Immigration Problem

  Ms. Lank: I need to add my spouse to my deed because I need to show immigration we have assets and debts jointly, so he could get his green card. However, I need to know how to title the deed to remove his name in case he does not get the card and gets deported. I found one method of holding title in my research on the internet (joint tenancy with right of survivorship's). Could you please give me the other methods of holding or any better suggestions you might have for the deed?
 
 

You should certainly consult a lawyer about this. As far as I know, once you have given part-ownership to your spouse,you can’t take his share back unless he agrees to sign it back to you.

If you are joint tenants, each will own an exact half. On the other hand, if a new deed reads that you two own as tenants in common, you could own unequal shares, perhaps with his being smaller. I don't know of any other way to do it, but remember-- I'm not a lawyer. Perhaps an attorney who specializes in immigration matters will have some suggestion.
