That's one that has been tried out in courts in the past and I can't give you an exact answer. Something might depend on the terms of the offer -- does it have any contingencies, is it subject to financing, is the closing date satisfactory, for example? If you did find yourself in that situation, you'd want to take your listing contract and the written offer to your own real estate lawyer for guidance. |
