During Eviction

  Hi there, I'm just wondering if I accept a partial rent payment while I'm going thru an eviction with a tenent, does the eviction become null and void? I say yes, wife says no! Thanks Edith and co. JW
 
  I'm not a lawyer, but it's my understanding that if you accept any payment after you've have an eviction order (or whatever they call it) the eviction does become void and you'd have to start all over again.  Why else would you tenant part with the money, unless they knew it would buy them more time?
