Dear Ms. Lank: I have a neighbor whose fruit trees hang over the wall into my backyard. One has hard heavy fruits.My concern is that these large fruits that fall off the tree from time to time might end up someday landing on one of my tiny two-pound dogs and cause serious harm or kill them.I've asked them to cut their trees back, but they refuse.Who is responsible for this and what steps can be taken to remedy this potentially hazardous situation? I don't want to damage the trees by attempting to cut them back myself and I don't want my dogs to be crushed to death by a fruit, either!
Well, that's certainly a new one.As you realize, whatever hangs in your air space belongs to you.Perhaps you could hire a tree professional to trim the branches properly.Perhaps you could block off the area beneath them; it shouldn't take a very high bit of fence for dogs that small.Perhaps you might just pick or knock down the fruits that worry you.
