We purchased a house in October 2007. Our escrow recently paid a $2400 delinquent tax bill from the previous owners that we were not aware of. What was the responsibilty of the closing agent to disclose this information? |

Yes, someone was responsible for finding that out before the closing. I can't point you in the right direction, for one thing because I don't know closing procedures in your area, which vary widely across the country. But in your situation I'd take someone into small claims court--the amount involved is just right for there. Take all the documents you have to a lawyer who specializes in real estate, and get advice. I'd be interested in hearing whether you should be suing the seller, abstract company, title company, seller's lawyer, your lawyer, bank's attorney, closing agent or someone else. While you're having the session with the lawyer, get advice about how to represent yourselves in small claims court. And to let me know what you find out; I'm interested. |
