Deed in Her Name |

The deed of my home is solely in my name. The mortgage is in the name of my ex husband. He wants his name off the mortgage, my name is not on the mortgage. He feels that he can sell this home despite that the deed is only in my name and he disappeared over 8 yrs. ago. I have paid the mortgage for over 8 yrs. and have spent much on repairs. Can he sell my home without my approval, simply because the mortgage is only in his name? He put the deed in only my name before he departed. |

Talk with a lawyer -- it sounds as if you need one. But if only the mortgage is in your ex's name, that won't give him any right to sell the property. If you have a recorded deed naming you as the sole owner, you're the only one who could sell. Perhaps all he's making a fuss about is getting his name off the loan. In many cases, if you have established a good payment record and can prove it (cancelled checks?) the lender will straighten the matter out. |
