Cloud on Title
  What happens if the title is not clear and the the title co has insured it several years ago?
 
  I haven't seen the documents, and I don't know what exceptions there may be on the title insurance policy.  It may be that the title company must clear the title or defend it -- I can't tell.  Take the matter to a real estate lawyer for advice.
