Can’t Find The Deed |

Dear Ms. Lank: My brother-in-law died earlier this year, and I am trying to help my sister with some business matters. My sister does not have a deed for their home and has no idea how to get one. I told her f she is paying taxes on the property, there is a paper and a deed that she can obtain. Would you please let me know if I gave her good advice? I work for a government and have learned there are permits with any construction and deeds for homes. |

If a copy of the deed to that house was entered into her county's public records office (and it almost certainly was), your sister has nothing to worry about. Owning doesn't involve holding a document or a piece of cardboard, the way it does in a game of Monopoly or with the title to a car. If and when your sister sells her house, she will transfer ownership by signing a new deed anyhow. When someone dies, however, no matter how simple the estate, it's wise to have at least a single session with a lawyer, to find out if anything needs attention. |
