The issue is my sister and I no longer want this tenant to remain living in our house.We do not want to live in fear that she will try to sue us for every little thing that happens and if she is not happy with the conditions of the place she should move.
We were told by the insurance company as well as a few lawyers that handle evictions to wait at least six month to do anything so she wouldn't claim "retaliation eviction".
Do we need a different reason or do we have to have a reason to evict this tenant?Her rental terms are on a month-to-month agreement.
As long as you give proper notice (in most locations, one full month before the first) you don’t need to give any reason for telling your tenant to leave.Do it in writing, registered mail.That’s not a legal eviction, it’s simply notice that the you choose not to renew the month-to-month tenancy.Follow the lawyers’ advice about timing, and don’t get into any discussion about your reasons.
