We are going to sell our house in a couple of years and we have built a fence in the backyard despite a deed restriction. There is no homeowners association or local enforcement of the restriction. Will this cause us a problem when we sell the house?
As you probably know, the deed restriction could be enforced by your neighbors if they wanted to go to court. You should of course disclose the situation to prospective buyers. It might bother some, might not bother others is my guess.
