Wife Changes Her Mind |

As a buyer, I have a signed purchase agreement and addendum. Now the seller wants to write a new contract because she no longer agrees with specific conditions included in the original purchase contract. If she writes a new purchase agreement that we will not accept, can we hold her liable for the original agreement and make her sell the home to us? If she refuses to close due to this new disagreement, can we take possession of the home anyways? |

If the original contract is signed by both buyer and seller who agreed to the exact same terms, you would have a binding contract. You could probably hold her to that agreement, but it's worth showing the document to your own real estate lawyer at this point so you're sure where you stand. As for "taking possession" -- if you mean to move in by force? -- that's out of the question of course, until you'd paid the money and received a deed to the property. |
