We bought a home in December 2007 and I have subsequently become aware of some problems with the disclosure form the seller provided. First, she indicated that no additions/remodels have been done to the property. I have learned from neighbors that the kitchen was remodeled after the owner purchased the home from the builder. Secondly, I learned there was a leak in the pool which was fixed by the owner but I feel this should've been disclosed. How should we handle these 2 issues since we've already closed on our purchase of the home. |

If you feel you've suffered some dollar damages you can go to small claims court, represent yourselves at little cost, and see what a judge has to say. Otherwise, it's hard to say just what you can do -- you can talk with a lawyer to see if you can sue someone for lying, but be prepared to answer the question "What do you want?" Perhaps if you could swear you wouldn't have paid as much for the place if you'd known about the addition, or the pool repair, you might make a case out of it. I'm skeptical, though. I don't think there's any legal requirement that past repairs be disclosed. |
