Purchased home with small right of way walking passage but no driveway. Realtor said that there was onstreet parking. After purchasing the home found out that there was no on street parking confirmed by city officials. Being forced to pay neighbor for a rented parking space. And cannot sell the house because of the parking situation as there is no where to park without paying the neighbor for it. Can we sue the Realtor for misleading us?
Anyone can always sue anyone about anything. Your question, I suppose, is could you prevail in court? You'd have to prove what the broker told you, and it might come down to your word against the Realtor's. It may be worth exploring this with a real estate attorney. Or you could sue for the dollar limit in small claims court, and see what a judge has to say at little or no cost, representing yourselves. Even so, I'd consult with an attorney first to get advice about doing that, and an opinion on whether it's worth trying. You might ask the lawyer if the seller bears some responsibility for not disclosing what is really a major defect in the property.
