Problems Turned Up

  In July of 2005 , hubby and I bought the home we are currently in. Upon moving a work bench in the basement today that the sellers so graciously left for us, we discovered a major crack in the foundation that has obviously been caulked before and appears to be leaking moisture into the french drain which is probably why the sump pump runs numerous times a day . In addition about 8 months ago we discovered that the sellers lied on the questionaire about the security system. Our realtor says to cut our losses and go on. We did have a home inspector but apparently he missed these things. Do we have any recourse?
 
  Don't take your legal advice from a real estate broker.  By all means take all the documents you have, including if possible estimates of the cost of repairing the problems, to a lawyer who specializes in real estate.  The attorney can advise on what to do next and whether to go after the home inspector or the seller or both. The general rule is that to collect damages you need to prove that the seller knew about the problem and deliberately concealed it.
