Pet Odor Emerges

  I have never seen this problem addressed before, hope you can help. My daughter purchased a condo in February of this year. Now that the weather has warmed up, there is a strange & nasty odor in her unit. When talking to a neighbor last week, the neighbor informed us that the unit right next to my daughters was condemed by the town of Chili for pet odors. The odor was so bad that it permated through all six units. They had like 5 cats & 2 dogs. The town made the owner rip out the flooring, carpets and even the drywall. We think that either my daughters drywall or common cement slab must have also been stained with pet urine. My questions are: Should this situation have been disclosed either by the seller or the HOA? What legal if any recourse does my daughter have. She does not have any extra finances to correct this situation. She would have never purchased this condo if she knew about the problem beforehand. Thank you.
 
 

I can think of several remedies -- that might or might not work.  First your daughter can go to small claims court and ask the seller for enough money to remedy the situation.  Or, based on her statement that she never would have bought if she'd known, she can sue to cancel the purchase.  She must consult a lawyer who specializes in real estate, who may have other advice.
