Paying the Salesperson

If a Sales person finds the type of home an investor is looking for and the sales person refers it to the Investor, does the Investor have to send the referral fee in the name of the agent's Broker or can he pay the Agent directly?

In most states, a licensed salesperson is not allowed to accept money for real estate services from anyone except his or her supervising broker.  Commissions and other fees are paid to the brokerage, which then shares the money according to its own agreement with the salesperson.
