Hello, My question revolves around a parcel of land that my father and mother purchased when I was child. My mother has since passed away (dad is re-married and living in Germany). He has wants to transfer the parcel to me (I live in Canada), but I'm not sure how to proceed exactly. The county clerk's office in Florida wasn't exactly helpful in terms of how we should proceed. My research has brought up Quit Claim Deeds, Power of Attorney as options. What would be the best way to proceed. I am not interested in paying any transfer taxes; this is supposed to be a gift to me. I would, of course, be responsible for the yearly taxes on the property. Thank you for your time and assistance.

The county clerk is responsible for recording documents, but is not supposed to give you legal advice. You need to talk with a lawyer or a title company, in the area where the land is located, about the procedure for transferring the property. I believe most states don't charge a transfer tax when the property is a gift. |
