Eight Siblings |

I am not sure you can help...but thought it was worth the effort.
I am one of 8 siblings in Minnesota and my parents purchased and have since paid off a cabin in northern Minnesota.
Due to my parents having some serious medical issues approx. 3 years ago, they asked me what could be done to protect the asset if something would happen and I suggested a quick claim deed. They made the decision to do a quick claim deed to two of my brothers for immediate. However, they requested that this be a short term fix and the long term plan would be to have all 8 siblings on the deed. Well, you probably guessed it. All 8 siblings were in the same room at the same time in 7 years so the question came up about re-doing the deed so all 8 siblings were on it at my parents request. The two brothers that the cabin was quick claim deeded to have decided they have no interest in making changes to deed. So, my question is kind of a two part question. Do we have a leg to stand on in terms of my parents original request for all 8 siblings to be on the deed? Second, if the two brothers would decide to proceed with the change to the deed in adding all siblings, what type of agreement/trust etc. would be recommended in order to make sure we are all clear on who will pay the taxes upkeep etc.

I doubt if you'd get too far suing on the basis of your folks' spoken promise, as compared with their signatures on that deed. But I'm not a lawyer, and your own attorney may think differently. In any event, you should consult an attorney, preferably one who specializes in elder law, about the best way to structure things if there is a change. |
