Dual Agency |
| |
 |
Can a realtor who is selling a property sell the property to one of their potential buyers and therefore be the buyer and the seller broker at the same time? |

You've touched on the problem of possible dual agency -- which is treated differently, these days, in different states. In most places, it's understood that the listing agent is working for the seller only, putting the seller's interests first, and owing the buyer nothing but honest treatment. In some places, both parties are asked to agree to dual agency, with the understanding that neither will receive full undivided loyalty. AN agent is required to put the client's interests first -- and there's only one first. So most times an agent should make it clear which party is the client and which is the customer. |
