Agent is Tardy |

If I don't close on my contracted date of 12/5 I must pay $100 per day until I close (foreclosure purchase). My agent is trying hard, but the listing agent is dragging their feet on making minor repairs requested by my VA Appraisal and because of their delays, I am in danger of not closing on time. Is there any recourse for me if I can't close on time due to the lazy listing agent? Help! |

Talk with the supervising broker in that office. Perhaps you might mention--and it would come even better from your lawyer--that you will hold the office liable for that $100 a day. Drop the words "small claims court" into the conversation, because that really will be a good place to pursue the matter if you have to. Keep careful records of all phone calls and the like, and copies of every document involved. Let me know what happens, I'll be worrying for you.
You can also talk with your lender or the VA about the possibility of a closing anyhow, with enough money held in escrow to cover those repairs, to be released to you after the work has been done. I don't now if they'll agree, but it's worth a try. |
