Disclosing to Buyer |

OK I'm not sure if you can answer my question, but its worth a try. I'm trying to get my RE liscense and I'm studying but I have a question. What all do you have to disclose about the property...ex: Prior drug use, prior alcohol sales, a death. I'm not sure I have looked through my Missouri Laws and statues and I cant find the answer. Also does it matter if you are the seller's agent or the buyer's agent. Or is it all rules of disclosure apply to both..thanks for you time |

Drug or alcohol use by a previous owner has nothing to do with the physical condition of the property. Neither does a death on the premises. Those are known as "stigmas". States vary in their requirement for disclosure to a prospective buyer, and in Missouri I understand that they need not be disclosed by the seller or seller's agent. On the other hand, a buyer's agent is duty-bound to tell the buyer whatever the agent knows about the property. |
