If You Invite Agents
|
The agents you have invited to your home for listing presentations have the task of convincing you that they are the right persons to handle your property. These initial interviews will cost you nothing, and you will not be obligated in any way. Even if you like the first agent who calls, it can be educational to talk with several others before making your decision. If you are planning to interview several agents, inform them at the outset that you will do so before making any decisions.
The listing is an employment contract under which you agree to pay a commission to the broker for securing a purchaser who is ready, willing, and able to pay the price and comply with the terms that you have specified. Strictly speaking, this contract might be enforceable by the broker even if you were not the owner of the property, and even if the transaction were never completed. In theory, the broker’s function is completed when he or she finds a buyer who satisfies the requirements you have specified. In practice, the listing contract often contains provisions further regulating the payment of commission that protect both you and the broker. You may want your lawyer to review the contract before you sign it. |
